Legalities Involving Franchise Restaurants

Are you legally prepared to own your own franchise restaurant? There are many legal issues that you should know when it comes to owning a franchise business. The more informed that you are beforehand the fewer mistakes you'll make along the way. There are some business lawyers who specialize in franchise law who can offer you the advice that you need to make the right choices for you and your business.

There are some specific legal questions that you need to ask before you decide if owning a franchise restaurant is for you. You need to start your business knowing as much as you can about the legalities of owning a franchise as you can:

  • Have you had your lawyer carefully look over the franchise contract and discuss all the points with you? Before you sign any papers make sure that you have all the answers to questions no matter how insignificant you think the question may be. You don't want to sign on the dotted line only to find that you have no control over the location of your new franchise business when you once though that you did. Find a good business lawyer who has experience with franchise businesses.
  • Are you being asked to do anything that you or your lawyer question as being entirely legal? If there is any aspect of the contract that you or your lawyer find is questionable make sure that you clarify these points ahead of time. Remember that no question is too small to ask when it comes to owning your own business. After all, it's your money that is on the line.
  • Have you been given a territory that is exclusive to you for the entire time that you own the franchise? You want to make sure that they area location that you have been given is exclusive to you for the entire time that you own the franchise.
  • Under what conditions can you terminate the franchise contract? What happens if you find that you're not the right person to own a franchise business? These are answers that you need to find so that you're prepared for anything, include the termination of the business.
  • Should you happen to sell your franchise, will you be fairly compensated? If you deicide to sell the franchise will you receive some type of monetary compensation or will you be left in the cold when it comes to money.
  • Is there are a franchising law where you live that regulates the sale of franchises? Has this law been complied with? Have your lawyer check to see if all the laws in the area where you live have been met. You don't want to find out later that you are in violation of franchising laws and are subject to a fine or worse.

Make sure that you understand all the legal issues regarding the purchase of your franchise so that there are no hidden surprises after you've bought the business and are in operation.
